FOX23 WXXA-TV/DT has established the following general rules for contests sponsored by the station and websiteFOX23News.com, following guidelines established by Newport Television and the National Association of Broadcasters. Unless otherwise stated in specific contest rules, these are the guidelines FOX23 WXXA-TV/DT follows for all contests. Specific rules for each contest will be posted on the contest page of FOX23News.com. Rules pertaining to daily contests for giveaways on FOX23 News, airing weekdays from 5am-8am are as follows:

To participate, caller must be 18 years of age All giveaways must be picked up at the studio located at: FOX23 28 Corporate Circle Albany, NY 12203 During normal business hours (8:30-5:30 weekdays)

Contest rules are available on line at www.fox23news.com and also available by sending a self-addressed stamped envelope to: Contest Coordinator, FOX23, 28 Corporate Circle, Albany, NY 12203. Giveaways will be provided to the 23rd caller after the giveaway is announced. The winner will be announced on the day of the giveaway on air during FOX23 News DayBreak following the receipt of the 23rd caller.

No purchase necessary. One entry per household. (“Household” includes spouses, children, parents, significant others and/or roommates.) Employees of FOX23, Newport Television LLC, its affiliated TV and internet sites and subsidiaries, participating sponsors, and employees’ immediate families (including spouses, children, parents, significant others and/or roommates), are ineligible to win. Winners must be 18 years or older.

Contests are open to residents of the Albany, Schenectady, Troy Designated Market Area (DMA), as defined by Nielsen Media Research (May 2007), including the counties of Berkshire, MA Franklin MA, Cheshire MA, Albany NY Columbia NY, Delaware NY, Dutchess NY, Essex NY, Fulton NY, Greene NY, Hamilton NY, Montgomery NY Otsego NY, Rensselaer NY, Saratoga NY, Schenectady NY, Schoharie NY, Ulster NY, Warren NY, Washington NY, Bennington VT, Rutland VT, Windham VT

By entering this contest, participants agree to be bound by these Official Rules and the decisions of WXXA-TV/DT. Winners must fully accept the terms of this contest to receive prize packages or another winner may be selected.

Winners are responsible for all applicable taxes and agree to release WXXA-TV/DT, Newport Television, participating sponsors, and related businesses from all liability of prize dysfunction or expiration. WXXA-TV/DT reserves the right to substitute prizes. Decisions of WXXA-TV/DT are final.

WXXA-TV/DT is not responsible for any human error that may occur in the processing of the entries, nor is it responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorized access to or alteration of entries, or for technical, network, telephone, computer hardware or software malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems.

Winner certifies that neither they nor anyone in their household (including spouses, children, parents, significant others and/or roommates) have won a contest and/or prize from WXXA-TV/DT in the last thirty (30) days from the date they are awarded the above mentioned prize. (If prize value exceeds $100 dollars in value, time increases to 90 days.)

All prizes valued over $100 will require the winner to fill out a W-9 tax form.

Winner may be required to pick up prizes in person at the WXXA-TV/DT studio.

Acceptance of prize constitutes permission for this Newport Television station to use winner’s name, voice, and/or likeness for promotional purposes. Winner also understands that there will be no reimbursement for use of this footage and that WXXA-TV/DT retains all rights to this material.

Federal, state, and local laws and regulations apply. Void where prohibited or restricted by law. No responsibility is assumed for lost or misdirected entries or in determining winners.
