PITTSTOWN, N.Y. – State Police say they arrested a Troy man for environmental conservation law violations.
According to authorities, police received a called from a resident on Johnny Cake Hollow Road in Pittstown of two men shooting in the roadway near the resident’s home.
The complainant said that when he approached the men, Thomas Fully, 24, fired a rifle over his head at a flying turkey buzzard.
Fuller and the second man left the area prior to police arriving to the location.
A Trooper and ENCON Officer say they arrived to the scene to find a dead rabbit where the witness stated the men were standing.
Fuller and Daniel Kocienski were later located and arrested.
Fuller has been charged with shooting within 500 feet of a dwelling, hunting turkey with a rifle, taking small game out of season, shooting over a public highway, and illegally attempting to take a protected species (turkey buzzard).
Kocienski was ticketed for taking small game out of season.
The two men have been released and will appear in Pittstown Court at a later date.
State Police say they believe the turkey buzzard was not injured.
