SCHENECTADY, N.Y. - Schenectady Police responded to a domestic dispute at 3290 Balltown Road Thursday morning which resulted in the suspect being shot and killed by an officer.
Authorities say they were called to the home by maintenance workers to investigate a domestic dispute between two men heard in the building around 9:20 a.m.
Police say the two men were in a domestic partnership and lived in the apartment together.
When officers arrived on scene, they discovered the suspect, 40-year-old Julio Colon, was wielding a knife and had stabbed the other male. Officers had to force their way through the front door of the home and then through the apartment door.
Officers asked the suspect to put the knife down, but they say he would not comply. It was when the suspect again lunged with a knife at the injured victim that police say the officer involved first shot the suspect once in the chest.
Police say the man then went after Sgt. Darryl Mallard with the knife, and was shot twice more. All three shots were to the chest.
The victim was taken to Ellis Hospital and is said to be in critical condition at this time. He will not be identified since he is a victim of domestic assault.
Lt. Mark McCracken of Schenectady Police says it appears Sgt. Mallard acted well within his rights, saying he was threatened and responded accordingly.
